Probate & Will Disputes – A will is a formal legal document setting out who inherits the will-maker’s assets once they die. The law recognises that a person has a right to decide who they want to inherit their assets. However, a will may be contested on a variety of grounds, including:
The will was not an accurate reflection of the will-maker’s intentions; or
There is a question as to the validity of the will; or
There had been inadequate provision made for someone the deceased should have provided for.
Probate Letters of Administration, in legal terms is the authority to administer the estate of someone who has died without making a will!
If a deceased person dies leaving a valid will, the executor named in the will has the duty to obtain a Grant of Probate in order, to deal with the estate’s assets and liabilities and distribute the estate in accordance with the will.
